VRacer Terms of Service

Welcome to VRacer. By using this app, you agree to comply with and be bound by the following terms and conditions. If you disagree with any part of these terms and conditions, please do not use our application.

For the purposes of these Terms:

• “Service” means the VRacer mobile app, website, and any related services, features, APIs, and content.
   
• “User Content” means content you submit or upload to the Service (including track submissions, lap/telemetry data, images, comments, and profile information).
   
• “VRacer Data” means data made available through the Service that is owned by or licensed to Velocity Software Ltd (including official track definitions, track maps, sector definitions, leaderboards, aggregated statistics, computed analytics, and any curated datasets).
   
• “Aggregated/Anonymised Data” means data that has been combined, summarised, and/or de-identified so that it does not reasonably identify an individual.
   
• “Scraping” means using automated means (including bots, scripts, crawlers, headless browsers, or similar techniques) to access, extract, harvest, copy, or download any portion of the Service or VRacer Data.

By creating an account, you agree to receive operational communications via email, including but not limited to account verification, service updates, and notifications pertaining to your account activity. These communications are essential for the use of VRacer and cannot be opted out of without impacting the functionality of your account.

Additionally, you may also receive promotional emails and offers related to VRacer that we believe may interest you. You will have the opportunity to opt out of receiving such communications through the unsubscribe link provided in every promotional email.

This app is strictly designed for racing purposes and should never be used on public roads.

Any track data submitted by users for official approval becomes the joint property of the user and Velocity Software Ltd. We may use aggregated or anonymised data in accordance with our Privacy Policy (https://vracer.io/privacy-policy).

You retain ownership of your User Content. By submitting User Content to the Service, you grant Velocity Software Ltd a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting/compatibility and to provide the Service), publish, display, distribute, and use that User Content to operate, improve, and promote the Service, including creating Aggregated/Anonymised Data and derived analytics.
If you submit track data for official approval, you acknowledge that VRacer may publish and maintain an official version of that track for use by other users.

You must not, and must not attempt to, directly or indirectly:

1. Scrape or Harvest Data: Scrape, crawl, collect, harvest, bulk download, or otherwise extract VRacer Data or any portion of the Service by automated means, or in a way that circumvents intended use, rate limits, or access controls. This includes systematic extraction by manual means, or using third parties to obtain VRacer Data on your behalf.
    
2. Reverse Engineer: Reverse engineer, decompile, disassemble, translate, derive source code from, or otherwise attempt to discover underlying source code, algorithms, data structures, or interfaces of the Service, except to the extent such restriction is prohibited by applicable law.
    
3. Circumvent Protections: Bypass, disable, interfere with, or defeat security features, access controls, paywalls, usage limits, geo-restrictions, or other protective measures used by the Service.
    
4. Redistribute: Copy, reproduce, publish, republish, sell, resell, license, distribute, or otherwise make available VRacer Data (including official track definitions, leaderboards, aggregated statistics, or computed analytics) to any third party, whether in raw form or as part of a dataset, except with prior written consent from Velocity Software Ltd.
    
5. Competitive Use: Use the Service or VRacer Data to develop, train, improve, benchmark, or provide any product or service that competes with VRacer, including creating or enhancing a competing track database, lap timing app, motorsport telemetry platform, racing analytics product, or similar service.
    
6. Use for Data Mining / Model Training: Use VRacer Data or any content accessed through the Service for large-scale data mining, automated analysis, or training/validation of machine learning or AI models, except with prior written consent from Velocity Software Ltd.

The contents of this app, excluding user-submitted content, are the property of Velocity Software Ltd. and are protected by copyright and other intellectual property laws.

Our intellectual property may not be used in connection with any product or service without the prior written consent of the Velocity Software Ltd.

Except as expressly permitted by these Terms, no part of the Service may be copied, modified, translated, distributed, sold, leased, or used to create derivative works.

We aim to comply with applicable privacy laws concerning all aspects of user data, including its collection, storage, and distribution.

We collect personal data such as email addresses and user-generated content for the purpose of providing and improving our service. This data is stored securely and will be erased upon account termination.

Users can upload images of their cars and share personal information within the app. No offensive or inappropriate images or text are permitted. We reserve the right to ban accounts and remove any such content without prior warning.

We encourage users to use their real names to facilitate profile visibility among other users. However, using pseudonyms or 'gamer tags' is also acceptable.

VRacer is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Velocity Software Ltd makes no warranties or representations of any kind, whether express or implied, about VRacer, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, availability, reliability, non-infringement, or that VRacer will be uninterrupted, error-free, or free of harmful components.

Velocity Software Ltd accepts no liability for any losses, damages, or any other adverse effects incurred while using our application.

The app is available on a subscription basis. Fees are payable through the Google Play Store and the Apple App Store.

Your subscription will automatically renew at the end of each billing period unless cancelled via your Apple App Store or Google Play account settings . Billing will occur on the same day of the period at the then-current subscription fee.

You may cancel your subscription at any time via your App Store / Play Store account. Cancellation will apply to the next billing period. All subscription fees are non-refundable unless required by applicable law.

On non-renewal or termination of your subscription, your access to paid-service features will cease. Any free-tier features, if available, will remain accessible. User-submitted content may be anonymised or locked in accordance with our Privacy Policy.

We may implement reasonable measures to protect the Service and VRacer Data, including rate limits, access controls, and monitoring for abuse. We may process technical and usage information for these purposes as described in our Privacy Policy.

We may suspend or terminate access to the Service immediately if we reasonably believe you have violated these Terms, including the Prohibited Conduct section.

Unauthorised use of the Service or VRacer Data may cause harm that is difficult to quantify, and we may seek injunctive or other equitable relief where appropriate.

Users can delete their accounts at any time. Upon deletion, all personal data associated with the account will be erased.

We reserve the right to modify these terms and conditions at any time, effective immediately upon posting updated terms. Users must review and accept these changes before continuing to use the app.

These terms are governed by and interpreted following the laws of New Zealand.

The Service may rely on third-party platforms and services (including Apple App Store and Google Play). Your use of those third-party services may be subject to their separate terms and policies. Velocity Software Ltd is not responsible for third-party services outside our control.
